9th Circuit Decision Prompts Trump Team to Write New EO

With the decision by the US 9th Circuit to uphold the TRO on Trumps January 27th EO, the white house has begun crafting a new order, one expected to comply with procedural due process.

The 9th Circuit's decision was based primarily on the lack of due process in the January 27 EO, especially where the court found that the EO violated the due process clause of the 5th Amendment. Without getting into the argument of what part of a visa is life, liberty, or property, the 9th Circuit reiterated that the courts do have the power to review executive actions, and that persons in the US are protected under the due process clause.
